§ 9.10. Civil service as to teachers and other educational employees.

  • The metropolitan board of public education shall constitute a civil service board for the purpose of investigating and hearing charges against any teacher and for the purpose of dismissing, suspending or otherwise disciplining the same and for the purpose of section 12.09 of this Charter. In the discharge of its duty as a civil service board, the metropolitan board of education is authorized to make rules and regulations. The provisions of section 12.11 of this Charter with reference to offenses against civil service and disabilities of civil service employees shall be applicable to all nonteaching employees of the board of public education. Any teacher suspended or dismissed may obtain a judicial review as provided in section 49-5-513 of Tennessee Code Annotated, the same being a portion of the Teachers' Tenure Act. Any nonteaching employee of the board may have his or her dismissal reviewed by the court in the same manner provided by section 12.07(h) for classified employees.
