§ 15.09. Recall election results—Votes required for election—Runoff election.

  • In any such recall election, the candidate receiving a majority of the votes cast for the office involved shall be declared elected and shall hold the office during the unexpired term of the incumbent. If at such recall election, some person other than the incumbent receives a majority of the votes cast, the incumbent shall thereupon be deemed removed from office upon the qualification of his or her successor so elected.

    If at such recall election no person receives a majority of the votes cast for the office involved, there shall be a runoff election and it shall thereupon be the duty of the Davidson County Election Commission to give notice and make all arrangements for the holding of such runoff election, and the same shall be conducted, returned, and the results thereof declared, as provided by law in the case of a general election for the office held by the incumbent to which the petition relates.

    In the runoff election, only the names of the two (2) candidates who received the highest number of votes cast for the office involved shall be placed on the official ballot. The runoff election, if required, shall be held by the Davidson County Election commission not less than thirty (30) days nor more than forty-five (45) days after it is determined that a runoff election is required.
