§ 1.10. Correction of errors.

  • If any change in records or error results in any member, survivor, contingent annuitant, or Beneficiary receiving from the system more or less than he would have been entitled to receive had the records been correct or had the error not been made, the commission, upon discovery of such error, shall correct the error by adjusting, as far as practicable, the payments in such a manner that the benefits to which the member, survivor, contingent annuitant, or beneficiary was correctly entitled shall be paid. If any change in records or error results in any member or the employer contributing to the fund more or less than should have been contributed had the records been correct or had the error not been made, the commission, upon discovery of such error, shall correct the error by adjusting, as far as practicable, the contribution payable by the member or the employer so that the total contributions paid will equal the amount payable had the records been correct or had the error not been made.
