§ 2.13. Delayed retirement—Conditions.

  • A member of Division A may remain in the active employment of the employer beyond his normal retirement date, if requested in writing to do so by the head of his department and with the written approval of the pension commission, and shall be eligible to retire on his delayed retirement date, which shall be the first day of any month following the effective date and his normal retirement date, and to receive a benefit as provided in Section 2.14. In no case shall a member of Division A, other than an official of the employer who is elected by popular vote, or by the Davidson County Quarterly Court, remain in the active employment of the Employer beyond his seventy-fifth birthday; provided, however, that such member of Division A who has reached his seventy-fifth birthday on the effective date shall not be required to retire for a period of three (3) years after the effective date.
