§ 3.04. Transfer of membership to Division A.

  • Such employee who is a member of Division B as of the effective date may elect voluntarily to transfer his membership to Division A, subject to written application received by the pension commission on or before September 15, 1961. Following the receipt by the pension commission of such application, he shall become a member of Division A as of the effective date; provided, however, that he shall not be eligible to receive any benefit provided by Division A unless and until coverage by the Social Security Act is effective. If a member of Division B who transfers his membership to Division A retires, dies, or terminates his employment prior to the date coverage by the Social Security Act is effective, he shall be eligible to receive benefits provided by Division B, and he shall not be eligible to receive any benefit provided by Division A. After the date Social Security coverage is effective, he shall have no right thereafter to any benefit provided by Division B.
