§ 16.28.175. Moving of houses, buildings, or structures.

  • A.

    Any person desiring to move any house, building, or structure shall obtain a moving permit as provided in this title. If the house, building, or structure is to be moved to another location within the jurisdiction of the metropolitan government, the application for the moving permit shall be accompanied by an application for a foundation permit and a building permit. Said building permit shall be accompanied by complete plans and specifications showing the changes or conditions of said house, building, or structure and all contemplated improvements, signed by the owner or the owner's agent. Exception: No construction plans are required for one and two family dwellings.

    B.

    Not later than forty-five days after the date the moving permit is obtained, the house, building, or structure must either: (1) be permanently affixed on a foundation at the new site; or (2) moved to a site outside of the jurisdiction of the metropolitan government.

    C.

    If a house, building, or structure is removed from the jurisdiction of the metropolitan government, said house, building, or structure shall not be moved back into Metropolitan Nashville and Davidson County unless another moving permit is obtained pursuant to subsection A. of this section. Any house, building, or structure to be moved back into Metropolitan Nashville and Davidson County shall be permanently affixed on its new foundation not later than thirty days from the date the moving permit is obtained. No house, building, or structure that was not originally built within the jurisdiction of the metropolitan government shall be permitted to be moved into Metropolitan Nashville and Davidson County.

    D.

    The owner of any house, building, or structure that is moved to another site within the jurisdiction of the metropolitan government shall make all necessary improvements required in order for said house, building, or structure to comply with the requirements of this Code not later than one hundred fifty days from the date the house, building, or structure is placed on its new foundation. The building official may grant one extension of sixty days upon a showing of delay caused by matters beyond the control of the owner or house mover.

    E.

    Moving permits issued pursuant to this Section shall include a condition that the exterior of the house, building, or structure to be moved be covered with an appropriate housewrap.

    F.

    Any person who fails to satisfy the above-mentioned time requirements shall be subject to the penalties set forth in Section 1.01.030 of the Metropolitan Code.

    G.

    No permit shall be issued for the moving of any house, building, or structure if the applicant for the permit has been found guilty of violating the provisions of this section, or of failing to satisfy the conditions of a previously issued permit for the moving of any house, building, or structure, by a court of competent jurisdiction within twelve months preceding the application for said permit.
