§ 12.08.220. Appeals.

Latest version.
  • A.

Any owner or lienholder of a motor vehicle aggrieved by the determination that a vehicle is an abandoned motor vehicle may appeal to the director of codes administration or his designee within ten days of receipt of the notice provided for in Section 12.08.210(K). Failure to appeal within the specified time period shall without exception constitute a waiver of the right of appeal, and consent to the demolition of the vehicle or its sale at a public auction.

    B.

After a hearing, the director of codes administration shall enter an order and send a copy to the owner and lienholder, stating whether the vehicle was properly determined to be abandoned. If such order states that the vehicle is abandoned, the owner and/or lienholder will be informed of the date that the vehicle will be taken into custody if not removed.
