§ 12.40.040. Stopping, standing or parking—Prohibited locations.

  • A.

    Except when necessary to avoid conflict with other traffic, or in compliance with regulation of the directions of a police officer or official traffic-control device, no person shall:

    1.

    Stop, stand or park a vehicle:

    a.

    On the roadway side of any vehicle stopped or parked at the edge or curb of a street,

    b.

    On a sidewalk; however, a bicycle may be parked on a sidewalk unless otherwise posted if it does not impede the normal and reasonable movement of pedestrians or other traffic. Any vehicle in violation of this provision shall be towed and the owner or operator shall be responsible for the payment of the towing charges,

    c.

    Upon any median, buffer strip, planting strip or landscape strip located between a sidewalk and roadway,

    d.

    Within an intersection,

    e.

    On a crosswalk,

    f.

    Between a safety zone and the adjacent curb, or within thirty feet of points on the curb immediately opposite the ends of a safety zone, unless a different length is indicated by signs or markings,

    g.

    Alongside or opposite any street excavation or obstruction, when stopping, standing or parking would obstruct traffic,

    h.

    Upon any bridge or other elevated structure upon a highway or within a highway tunnel,

    i.

    On any railroad tracks,

    j.

    At any place where official signs prohibit stopping, standing or parking;

    2.

    Stand or park a vehicle, whether occupied or not, except momentarily to pick up or discharge a passenger or passengers:

    a.

    In front of a public or private driveway,

    b.

    Within fifteen feet of a fire hydrant,

    c.

    Within thirty feet of a crosswalk at an intersection,

    d.

    Within thirty feet upon the approach to any flashing signal, stop sign, yield sign or traffic-control signal located at the side of a roadway,

    e.

    Within twenty-five feet of the driveway to fire station and on the side of a street opposite the entrance to any fire station within seventy-five feet of such entrance, when properly signposted,

    f.

    At any place where official signs prohibit standing,

    g.

    On any controlled-access highway,

    h.

    In the area between roadways of a divided highway, including crossovers,

    i.

    In front of any postal mail drop or box,

    j.

    In any area designated "Residential Permit Parking Only" except for allowable time limit parking provided for vehicles without a residential parking permit;

    3.

    Park a vehicle, whether occupied or not, except temporarily, for the purpose of and while actually engaged in loading or unloading merchandise or passengers:

    a.

    Within fifty feet of the nearest rail of a railroad crossing,

    b.

    At any place where official signs prohibit parking.

    B.

    No person shall move a vehicle not lawfully under his control into any such prohibited area or away from a curb such a distance as is unlawful, as set out in Schedule VII.

    C.

    The owner of any personal property or motor vehicle found in violation of subsection A.1.e. of this section shall be subject to a fine in the amount of fifty dollars, which shall be assessed by the issuance of a parking citation.

    D.

    The parking of abandoned motor vehicles shall be controlled pursuant to Sections 12.08.210 through 12.08.220.

    E.

    Notwithstanding the general signage requirements of section 12.40.020 of this chapter to the contrary, no person shall stop, stand or park a motor vehicle within any bicycle lane unless the metropolitan traffic and parking commission has determined that parking within the bicycle lane in specific locations is appropriate during certain hours and signs have been erected in the designated area(s) to that effect. The owner of any motor vehicle found in violation of this subsection shall be subject to a fine in the amount of fifty dollars, which shall be assessed by the issuance of a parking citation.

    F.

    In parking lots with designated spaces for ten or more vehicles, no vehicle shall be parked in a space designated for charging any electric vehicle by any sign or pavement marking using the term "electric vehicle charging," or otherwise reasonably indicating designation for electric vehicle charging, unless the vehicle is a plug-in electric vehicle. The owner of any motor vehicle found in violation of this subsection shall be subject to a fine in the amount of fifty dollars, which shall be assessed by the issuance of a parking citation. In spaces designated for charging an electric vehicle on property owned by the Metropolitan Government of Nashville and Davidson County, such spaces shall be marked with official signs or pavement markings to prohibit parking of any vehicle other than plug-in electric vehicles. On or before January 1, 2018, any space designated for charging electric vehicles in parking lots with designated spaces for ten or more vehicles must be marked by a sign, pavement marking or other indication that parking of non-electric vehicles in such space is prohibited. As used in this section, "plug-in electric vehicle" shall mean any motor vehicle that draws electricity from a battery that is capable of being charged from an external source.
